III. Software Piracy
An Enterprise/Organizational purchase of the Crime-IQ program includes: One (1) Enterprise/Organizational license to the Crime-IQ Web Application (the “Enterprise License”) for up to the total number of Named Users identified in the Sales Order.
A single purchaser “License” includes username/password access to the Crime-IQ program on two devices (mobile or desktop) owned by the “Licensee.” Access to the Crime-IQ program may not be split to include a NON-LICENSEE.
The License Term is one (1) year from the date of Delivery.
An individual purchaser of the Crime-IQ software (“Licensee”) has the right to access Crime-IQ on two devices owned by the Licensee. It is illegal for the Licensee to provide access to the Crime-IQ software to a non-Licensee or to make or distribute copies of that software for other purposes unless permission has been obtained from the copyright owner. Software piracy is a federal offense and constitutes copyright infringement, regardless of whether it is used for sale, free distribution, or personal use. If you pirate software, you may face not only a civil suit for damages and other relief, but criminal liability as well, including fines and jail of up to five years for a first offense, and ten years for a second offense. Copiers are liable for the resulting copyright infringement even if they were not aware that their conduct violated federal law.
IV. Personal Use Only
The Site and Services are made available for your personal, non-commercial use only. You may not use the Site to sell a product or service, or to increase traffic to your Web site for commercial reasons, such as advertising sales. You may not take the results from a search and reformat and display them, or mirror the Company home page or results pages on your Website. You may not “meta-search” the Site. If you want to make commercial use of the Services, you must enter into written agreement with us to do so in advance.
V. Return Policy
All sales are final. Because Crime-IQ offers a free trial of the program for evaluation to ensure that this product will meet your needs without the need to purchase, there will be NO REFUNDS
Before deciding to purchase the software, please be sure to take advantage of the free trial period to evaluate the program that we provide. We do not offer refunds on software that has been delivered to customers. Unlike physical goods, electronically distributed software cannot be “returned” to the seller.
We make available for download a free trial version of each product we offer. Customers are encouraged to download the free trial version and test it prior to purchasing a license to the release version of the applicable product.
If a customer purchases a license, we do not offer a cash refund or an exchange. Unlike physical goods, electronically distributed software and software licenses cannot be returned. Accordingly, it is our policy that once we have distributed the software access to a customer, the sale is final, and you may not return the software access for a refund or credit.
VI. Modifications
The content of this software and website is periodically changed or updated without notice. No liability or responsibility is assumed for any errors or omissions in the contents of this website or software product. Your use of this website and software is at your own risk. Under no circumstances shall Crime-IQ or any other party involved in the creation, production or delivery of this product or website be liable to you or any other person for any indirect, special, incidental, or consequential damages of any kind arising from your access to, or use of, this product or website.

This website may occasionally contain links to third party websites for the convenience of our users. Crime-IQ does not endorse any of these third party sites and does not intend to imply any association between the party(ies) involved. If you use any links to third party websites, you do so at your own risk. These links are provided only as a convenience to the user.
VIII. Severability
If any provision hereof shall at any time be held to be void, invalid or unenforceable, such provision shall be construed as severable and shall not in any way affect or render void, invalid or unenforceable any other provision of this Agreement, and this Agreement shall be carried out as if such void, invalid or unenforceable provision were not part of this Agreement.
IX. Limitation of Liability
UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, RELIANCE, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, COST OF COVER, OR LOST DATA THAT ARISE IN WHOLE OR IN PART FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR THE SERVICES, OR YOUR RELIANCE UPON THE SITE OR THE SERVICES, OR OUR PROVISION OF, OR FAILURE TO PROVIDE, THE SITE OR THE SERVICES, WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ADDITION, WE HAVE NO DUTY TO UPDATE THE SITE OR THE CONTENTS THEREOF. IN NO EVENT SHALL WE BE HELD LIABLE TO AN INDIVIDUAL PURCHASER OR COLLECTIVE AGENCY PURCHASER FOR ANY DAMAGES, LOSSES, AND CAUSES OF ACTION (WHETHER IN CONTRACT OR TORT) INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, OR OTHERWISE. IF YOU ARE DISSATISFIED WITH THE SITE OR THE SERVICES, YOUR SOLE AND EXCLUSIVE REMEDY SHALL BE TO DISCONTINUE USE OF THE SITE AND THE SERVICES.
X. Governing Law; Other
The laws of the State of California, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and us or any of our affiliates. You agree not to commence or prosecute any action in connection therewith other than in the state and federal courts located in Oakland, California, and you hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to, venue and jurisdiction in the state and federal courts of Oakland, California.
XI. Dispute Resolution and Arbitration.
Any claim, dispute or controversy arising out of or relating to the Goods and Services or this Agreement shall be resolved exclusively by binding arbitration in Oakland, California, in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
